1. Introduction
Welcome to PublicServiceConsortium ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at publicserviceconsortium.sbs (the "Service") operated by PublicServiceConsortium.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
PublicServiceConsortium offers luxury yacht charter services, which include, among others:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Long-term charters
Service availability is contingent on numerous factors including current conditions. We may change or halt offerings as circumstances dictate.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht, you are required to:
- Be minimum age of 18 years
- Supply correct and complete details
- Make a payment for the designated deposit stipulated in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A reservation is only secured when we have received the appropriate payment and issued a written confirmation. We maintain the sole discretion to decline service to any individual.
3.3 Availability
The allocation of charters is dependent on the availability of vessels and favorable weather conditions. We intend to accommodate your preferred timings and dates as far as practicable.
4. Payment Terms
4.1 Pricing
All quoted fees are in € and include relevant taxes, unless specified otherwise. Fees may be subject to alterations without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the entire charter fee is required at the time of reservation
- Final Payment: To be settled no later than 48 hours prior to the scheduled departure
- Incidental expenses (if applicable): Payable following the completion of the charter
4.3 Payment Methods
We accept widely-used credit cards, electronic funds transfers, and bank-certified drafts. All payment processes are conducted through secure and encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours notice prior to departure: Entire refund minus processing fees
- Between 24 and 72 hours prior to departure: Refund of 50% of the total cost
- With less than 24 hours notice before departure: No refund will be issued
5.2 Weather Cancellations
Should the captain determine weather conditions to be unsafe, we propose to:
- Arrange an alternative date for your charter at no additional charge
- Issue a complete refund if rescheduling is unfeasible
5.3 Mechanical Issues
If there are mechanical difficulties with the designated yacht, efforts will be made to supply an equivalent replacement. In the absence of a suitable alternative, a comprehensive refund will be provided.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Comply with all directives from the crew
- Use safety gear as needed
- Inform of any health conditions that could impact their safety
- Stay within the designated areas on the craft
6.2 Prohibited Items
Certain items are not allowed onboard:
- Glass receptacles
- Illicit drugs
- Weapons
- Excessive alcohol (beyond moderate consumption)
- Animals (unless granted prior permission)
6.3 Conduct
Guests should behave respectfully at all times. We retain the right to abort a cruise prematurely and without refund should guest behavior threaten safety or impede the enjoyment of the excursion for others.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the costs paid by you for the yacht charter and we are not accountable for:
- Injuries to persons arising from their own carelessness
- Lost or damaged belongings
- Indirect losses, consequential or punitive damages
- Setbacks due to weather or situations outside our influence
7.2 Insurance Coverage
We ensure that we hold inclusive marine insurance for our vessels and operations. Charterers are urged to secure their own cover for travel and personal belongings.
7.3 Assumption of Risk
By partaking in our charters, you acknowledge and willingly assume the risks associated with maritime endeavors, assuming full responsibility for your personal safety and security.
8. Modifications and Itinerary Changes
We reserve the right to adapt itineraries, courses, or timetables due to factors such as climate conditions, safety considerations, or operational demands. We strive to offer suitable alternatives where feasible.
9. Force Majeure
We are exempt from responsibility for delays, cancellations, or alterations resulting from incidents outside our control, which include, but are not restricted to:
- Treacherous weather
- Natural catastrophes
- Government edicts
- Harbor shutdowns
- Mechanical malfunctions
10. Privacy and Data Protection
Your privacy is regulated in accordance with our Privacy Policy. By utilizing our services, you consent to our collection and application of your specifics as specified in our Privacy Policy.
11. Intellectual Property
The proprietary content on our website, encompassing writings, visuals, trademarks, and imagery, is safeguarded by intellectual property laws. Unauthorized replication, dissemination, or the creation of derivative works without our explicit consent is prohibited.
12. Governing Law
The jurisdiction of Germany presides over these Terms, with any disputes to be settled in the courts of Hamburg, Germany.
13. Changes to Terms
We have the prerogative to alter these Terms whenever necessary. Amendments will be made public on our website with an updated revision date. Using our services after changes implies acceptance of any new terms.
